What is the Function of Miami Complaints?

Miami Complaints Office has no authority to make investigations of City, County, State, or Federal affairs. We will relay the complaints to the correct agency to investigate the past, present and proposed City, County and State Public Health Trust programs, accounts, records, contracts, and transactions. If the complaint is found to be justified, then we put it to the public for everyone to know that corrections are needed. In order to carry out these functions, we need your cooperation and records of your complaint.  We will send the records to the appropriate office that has the power to subpoena witnesses and require the production of documents. Additionally, Miami Complaints may report and/or recommend to the City, County, or State Commissioners or Representatives whether a particular law, project or contract is or was necessary, and if so, whether the method used is or was financially and operationally efficient. Furthermore, Miami Complaints will conduct random audits, inspections, and reviews of fraud, waste, financial mismanagement and corruption on all complaints.  

Why was Miami Complaints Formed?
Miami Complaints was created because of the lack of city, county, state, and federal employees, public officials, and elected officials not doing their job and blaming other agencies and use the excuse of not having the money to do the job.  Miami Complaint was set up to investigate and review allegations of waste, fraud, abuse and mismanagement from employees, public officials, and elected officials and to put these investigation into the public eye to inform the public of bad practices and misconduct.  Miami Complaints main objective is to make corrections to laws so that any misconduct and bad practices are not moved onto someone else.  Bad practices and misconducts only benefit bad people and are not what this county was built on.

What is the Jurisdiction of Miami Complaints?
Miami Complaints will report all waste, fraud, abuse and mismanagement from employees, public officials, and elected officials from city, county, state, and federal levels which include all city, county, state, and federal departments, agencies, instrumentalities, and the programs thereunder. Our commitment extends to all city, county, state, and federal employees, public officials, and elected officials. Miami Complaints also includes vendors and contractors doing business with the City, County, State, or Federal government. In essence, Miami Complaint is the watchdog over government policies and practices.

What are the Powers Available to Miami Complaints?
Miami Complaints has no official power to force any government agency or elected officials to do anything, but by pushing the information to the public has a lot of power within itself to make changes.  By reporting waste, fraud, abuse and mismanagement from employees, public officials, and elected officials can result in corrective actions.
Conversely, Miami Complaints may report to these same individuals its findings and recommendations arising from an investigation, audit, or review. Unless otherwise exempt from public disclosure, these findings and recommendations are generally released in a public report.

Is Miami Complaints a Law Enforcement Agency?
No. Miami Complaints is not a law enforcement agency. We send information to the agencies that handle your particular complaint.  We help you get started and follow up on the procedures and the outcome of your complaint.  If criminal intensions were involved within your complaint, then we will pass the information to the Federal Bureau of Investigation (FBI), General Attorney, County, City, or State Police for further investigation.

What Obligations Are Placed Upon Miami Complaints?
Where Miami Complaints detects criminal misconduct, Miami Complaints shall notify the appropriate law enforcement agencies. When Miami Complaints detects a violation of a matter falling within the jurisdiction of the Ethics Commission, he or she may file a complaint with the Ethics Commission or refer the matter to the Commission’s Advocate.

How Do I Report Acts of Fraud, Waste, Mismanagement, Abuse, and/or Corruption to the Miami Complaints?
You may report this information to us in one of four ways. You may report your concerns to us by mail or fax in a written complaint. You can stop by our office and meet with a Miami Complaint Agent and provide the information directly to us. You may call our hotline at (786) 286-0773 or access our secure email via this website to provide us with the information. In any event, you may remain anonymous; however, you are encouraged to identify yourself so that we may follow up on your call or email and obtain additional information that would help us in an our investigation.
If you give us your name, your identity will be protected to the maximum extent of the law. In addition, there are certain provisions under Florida law and the Code of Miami-Dade County that protect employees and independent contractors, engaged in business with the City, County, State, or Federal government and who have entered into a contract with the City, County, State, or Federal government, from retaliation under certain circumstances. If you believe that making a report to the Miami Complaints will place you at risk of retaliation, you should inform Miami Complaints of this fact.

How Do I File a Complaint Without Losing My Job as a County Employee?
Under certain circumstances, Miami Complaints may be able to provide you with confidentiality. In addition, there are provisions under Federal, Florida law and the Code of Miami-Dade County that protect employees from retaliation under certain circumstances.

When Does Miami Complaints Initiate an Investigation?
Investigations are only initiated upon the receipt of credible information alleging an act of fraud, waste, financial mismanagement or corruption within City, County, State, or Federal agencies. Miami Complaints can only submit the information to the authorized agency and that starts the initiation of an investigation.  Only the official agency can actually start the formal investigation, but Miami Complaints can put it in the right direction to get the investigation started.

Are Miami Complaints Investigations Confidential?
Ongoing audits and investigations are exempt from public disclosure. However, once an audit or investigation is finalized it becomes a public record, pursuant to Florida’s public records laws.

When are Reports of Investigations Made Available to the Public?
Once Miami Complaints closes an investigation, it will either close it out all together if there is not merit found to keep it open or it will pursue it further by publicizing the outcome of the investigation to get better support.  However, the agency that we submit your complaint to, the report or audit is usually made available to the public by filing it with the Clerk of the Board and through its publication on their website.

When Should I Contact Miami Complaints?

What Happens If Miami Complaints Does Not Have Jurisdiction Over a Matter?
Miami Complaints will become a major player in reporting government mis-handling of government issues.  There will not be any jurisdiction that Miami Complaints will look into within the United States of America.  However, Miami Complaints at this time will help you as much as possible or you will be notified of this fact, and whenever possible, we will refer you to the appropriate agency or organization that can provide assistance.
